Terms of Service

Last updated: Oct 21, 2024

We’re glad you’re here! Now let’s make sure we do this the right way. 👏 (aka Broadcat’s Websites Terms of Service)

You’re already on at least one of these, but just so we’re clear—Broadcat has two websites: https://www.thebroadcat.com and https://www.clubhouse.thebroadcat.com.

When we talk about them, we’ll just call them “Sites.” By accessing or using our Sites, you agree to these Terms of Use, as well as our Privacy Policy available at https://www.thebroadcat.com/privacy-notice.

  1. Use our Sites the right way.

While you’re here, you agree to use our Sites for lawful purposes only and consistent with all applicable laws and regulations. That means you won’t:

      1. Post or transmit any material that is unlawful, harmful, or violates any third-party rights,
      2. Use any automated means (such as robots, spiders, or other means) to access the Sites or collect information,
      3. Mirror the Sites or any part of them on any other website or web page,
      4. Engage in any activity that disrupts or interferes with the proper functioning of the Sites, or
      5. Misrepresent information you submit about yourself.
  2. This is our stuff (aka Broadcat Intellectual Property).

Everything we put on https://www.thebroadcat.com, like content, design, webinars, videos, and other materials, as well as text, graphics, logos, and software, is the property of Broadcat and is protected by applicable intellectual property laws. We know a lot of it is super awesome, so if you want to reproduce, distribute, or create derivative works, you need to get our explicit, written consent first.

If you are a Design Club member, all purchased and downloaded content on https://www.clubhouse.thebroadcat.com comes with a perpetual, worldwide, non-exclusive, non-transferable, non-assignable license for the Compliance Design Club materials you buy with tokens or receive as a gift. You can use, make copies of, edit, remix, translate, Frankenstein, chop up, and otherwise repurpose Compliance Design Club materials for internal compliance and training purposes, but you can't resell, market, or otherwise attempt to commercialize those materials.

  3. Your stuff.

If you add any content to the Sites, like comments or reviews, you’re granting us a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, publish, and distribute it.

  4. Everything is “as is” and “as available.”

We make no warranties, express or implied, regarding the operation of the Sites or the accuracy of the content provided. We do not guarantee that the Sites will be error-free or available at all times. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the content at any time without prior notice.

  5. Our liability is limited.

In no event shall Broadcat be liable for any damages arising out of or in connection with your use of the Sites. This includes but is not limited to, direct, indirect, incidental, punitive, and consequential damages. Content on our Sites is for informational purposes only and is not legal advice. Consult legal counsel to understand how compliance requirements apply to you or your company.

Also, Broadcat does not represent or warrant that your activities, including but not limited to downloads, on the Sites will be secure and will not be intercepted. We also do not warrant that the capabilities offered on the Sites will be uninterrupted, free from errors or defects, or that any such errors or defects will be corrected; the Sites, materials, and the servers that make the Sites and materials available are free of viruses or other harmful components; or that the Sites and the content are accurate, complete, current, or will be updated.

  6. Links to other cool stuff.

From time to time, the Sites may contain links to other things in the compliance universe that we think are useful (aka third-party websites). We are not responsible for the content or privacy practices of these sites, so if you choose to click on those links and access any third-party sites, you do so at your own risk.

  7. We can change our minds.

The future is unwritten so we reserve the right to modify these Terms at any time. If we do that, we’ll post it on this page and include an updated effective date. At that point, your continued use of our Sites means you accept those new Terms.

  8. We can choose who is allowed on our Sites.

We reserve the right to terminate or suspend your access to our Sites at any time, without notice, for any violation of these Terms or any other reason.

  9. Questions? Reach out!

All this stuff about using our websites can be confusing, so we’re here to help. If you have questions, please contact us at accounts@thebroadcat.com. Happy surfing! 🌊
